This agreement is between Prestige Bodyshop Repairs (“the Supplier”) and the Customer.
Definitions
1.1 The Customer means the person, firm or company authorising Prestige Bodyshop Repairs to carry out services on the vehicle.
1.2 Services means the repair, restoration, painting or servicing of vehicles and any other work carried out by Prestige Bodyshop Repairs including vehicle storage and, where applicable, the provision of a courtesy vehicle.
1.3 Completion Date means the estimated date when the services are expected to be completed.
1.4 The Vehicle means the vehicle left with Prestige Bodyshop Repairs for repair or service.
1.5 By leaving the Vehicle with Prestige Bodyshop Repairs or authorising work to begin, the Customer confirms that they are the owner of the Vehicle or are authorised by the owner to enter into this agreement and request that work begins as soon as reasonably possible.
Estimates
2.1 Any estimate provided is based on visible damage only and is therefore provisional.
2.2 Additional damage may be discovered once panels, components or assemblies are removed during the repair process.
2.3 If further work or parts are required, the Customer or insurer will be notified before work continues wherever reasonably practicable.
2.4 Estimates do not constitute a binding agreement to undertake the work.
2.5 A charge may apply for detailed estimates where dismantling or significant inspection time is required.
Hidden Damage
3.1 During the repair process, additional damage may be discovered once parts, panels or assemblies are removed.
3.2 Such damage may not have been visible during the initial inspection.
3.3 If further work is required to repair the Vehicle safely and correctly, Prestige Bodyshop Repairs will notify the Customer or insurer before proceeding wherever reasonably practicable.
3.4 Additional repairs may affect the final cost and completion time.
Safety and Repair Restrictions
4.1 Prestige Bodyshop Repairs reserves the right to refuse to carry out work if the requested repair could make the Vehicle unsafe or compromise its structural integrity.
4.2 Prestige Bodyshop Repairs may also refuse to road test a Vehicle if it is presented in a condition that would make it illegal or unsafe to drive on public roads.
Subcontracted Work
5.1 Certain specialist repairs or services may occasionally be carried out by approved third-party specialists.
5.2 Prestige Bodyshop Repairs will use suitably qualified and competent contractors where specialist services are required.
5.3 Any subcontracted work shall be deemed part of the Services provided under this agreement.
Replacement Parts
6.1 Any parts removed during the repair become the property of Prestige Bodyshop Repairs unless the Customer requests their return before the repair begins.
6.2 All replacement parts remain the property of Prestige Bodyshop Repairs until full payment for the repair has been received.
Paintwork and Colour Matching
7.1 Prestige Bodyshop Repairs uses professional paint systems and manufacturer-approved materials wherever possible.
7.2 Vehicle paintwork may fade, weather or change colour over time due to age, environmental exposure or previous repairs.
7.3 While every effort will be made to achieve the closest possible colour match, an exact match cannot always be guaranteed.
7.4 To achieve the best possible finish, technicians may blend paint into adjoining panels where necessary.
7.5 Windscreen Chips and Existing Glass Damage
Where a vehicle has an existing windscreen chip, crack or other damage to any glass prior to repair, the Customer acknowledges that the heat generated during the low-bake paint curing process (typically up to 50°C) may cause such existing damage to worsen or develop into a larger crack. This can occur naturally through exposure to heat, including sunlight, and is not unique to the paint curing process.
Customers are responsible for informing Prestige Bodyshop Repairs of any existing chips, cracks or damage to the vehicle’s glass before work commences.
Prestige Bodyshop Repairs cannot accept responsibility for the repair or replacement of any windscreen or other vehicle glass that cracks or fails during or after the normal low-bake paint curing process where the damage results from a pre-existing chip, crack or defect, provided that reasonable care and skill has been exercised in carrying out the repair.
Where possible, Prestige Bodyshop Repairs recommends that any existing windscreen chips or cracks are repaired before paintwork requiring oven curing is undertaken.
Glass and Component Removal
8.1 Certain repairs may require the removal of bonded windscreens, glass, trims, mouldings, clips, fasteners, panels and other existing components.
8.2 Prestige Bodyshop Repairs will exercise reasonable care and skill when carrying out such removal work.
8.3 The Customer acknowledges that due to factors outside the control of Prestige Bodyshop Repairs, including but not limited to age, corrosion, previous repairs, manufacturing defects, installation methods, adhesive strength, deterioration, hidden defects or the condition of the component, damage or breakage may occur during removal despite reasonable care and skill being exercised.
8.4 Prestige Bodyshop Repairs cannot guarantee that existing components can be removed without damage.
8.5 Where damage or breakage occurs during the reasonable removal of a component required to complete the repair, replacement parts, materials and associated labour costs may be chargeable to the Customer unless otherwise agreed in writing.
8.6 Where reasonably practicable, Prestige Bodyshop Repairs will advise the Customer of any known or anticipated risks before commencing work. However, the Customer acknowledges that some risks only become apparent once dismantling or removal work has begun.
8.7 By authorising the repair, the Customer acknowledges and accepts the inherent risks associated with the removal of existing bonded or fixed components where such removal is reasonably necessary to complete the repair.
8.8 Nothing in this clause excludes or limits liability for negligence, fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot be excluded or limited by law.
Completion Dates
9.1 Estimated completion dates are provided as a guide only.
9.2 While every effort will be made to complete repairs within the estimated timeframe, delays may occur due to additional damage discovered during repair, parts availability, insurer authorisation requirements or circumstances beyond our reasonable control.
Parts Availability
10.1 Repairs may occasionally be delayed due to manufacturer parts availability, supplier delays or discontinued parts.
10.2 Prestige Bodyshop Repairs cannot accept responsibility for delays caused by manufacturers or suppliers.
Insurance Repairs
11.1 Where repairs are carried out through an insurance claim, Prestige Bodyshop Repairs may liaise with the insurer on behalf of the Customer.
11.2 The repair process may be subject to insurer approval.
11.3 The Customer remains responsible for payment of any policy excess, VAT where applicable or repair costs not authorised or paid by the insurer.
Non-Fault Accident Repairs
12.1 Where the Vehicle is repaired following a non-fault accident, Prestige Bodyshop Repairs may assist with the claims process through approved accident management companies.
12.2 The Customer must provide accurate information regarding the accident and insurance details.
12.3 The Customer remains responsible for any charges not covered by the responsible party’s insurer.
Vehicle Collection
13.1 Customers will be notified when their Vehicle is ready for collection.
13.2 Vehicles should be collected within 24 hours of notification unless otherwise agreed.
13.3 Prestige Bodyshop Repairs may drive or road test the Vehicle as part of the repair process to ensure it operates correctly.
13.4 If additional fuel is required for testing purposes, a reasonable charge may be applied.
Payment
14.1 Payment must be made in full before the Vehicle is released unless alternative arrangements have been agreed in writing.
14.2 Where repairs involve an insurance claim, the Customer remains responsible for payment of any excess, VAT or outstanding balance.
Storage
15.1 Vehicles not collected within 24 hours of notification may incur storage charges.
15.2 Storage charges may also apply where repair authorisation is delayed and the Vehicle remains on site.
Courtesy Vehicles
16.1 Where a courtesy vehicle is provided, it must be returned when the repaired Vehicle is ready for collection.
16.2 Failure to return a courtesy vehicle within 24 hours may result in daily hire charges.
Right of Retention
17.1 Prestige Bodyshop Repairs reserves the right to retain possession of the Vehicle until all charges relating to the repair have been paid in full.
Liability
18.1 Prestige Bodyshop Repairs will take reasonable care of Vehicles while in its custody and will perform Services using reasonable care and skill.
18.2 Subject to Clause 8, Prestige Bodyshop Repairs shall not be responsible for damage resulting from the unavoidable removal or dismantling of existing components where such damage occurs despite reasonable care and skill being exercised and where removal was reasonably necessary to complete the repair.
18.3 Customers are advised to remove all personal belongings before repairs begin. Prestige Bodyshop Repairs cannot accept responsibility for personal belongings left within the Vehicle.
18.4 Prestige Bodyshop Repairs shall not be liable for delays, losses or additional costs arising from circumstances outside its reasonable control.
Inspection on Collection
19.1 The Customer is expected to inspect the Vehicle upon collection.
19.2 By taking possession of the Vehicle, the Customer confirms that the repair has been completed to their satisfaction unless concerns are raised at the time of collection.
19.3 Any issues relating to the repair should be reported to Prestige Bodyshop Repairs as soon as reasonably practicable.
Payment Disputes
20.1 Where payment has been made and the repair has been completed, the Customer agrees to contact Prestige Bodyshop Repairs directly to resolve any concerns before initiating a payment dispute or chargeback with their bank or card provider.
20.2 Prestige Bodyshop Repairs will make reasonable efforts to resolve any genuine concerns relating to the repair.
Consumer Rights
21.1 Nothing in these Terms and Conditions shall exclude or limit any statutory rights available to consumers under applicable law.
21.2 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability which cannot legally be excluded.
Governing Law
22.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
22.2 Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
